1. User Agreement

2. Service Usage

Xfiat provides a secure and efficient gateway to convert cryptocurrency to fiat currency and vice versa. You agree to use our Services in compliance with all applicable local, state, national, and international laws, rules, and regulations.

You shall not use the Services for any illegal or unauthorized purpose, including but not limited to, money laundering, terrorist financing, fraud, or any activity that violates the rights of others.

We reserve the right to monitor transactions for suspicious activity. Xfiat may suspend or terminate your access to the Services if we suspect any violation of these Terms or applicable laws.

You understand that cryptocurrency transactions are irreversible, and you are responsible for ensuring the accuracy of all transaction details before confirming any transfer.

3. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

(a) Using the Services for any fraudulent, unlawful, or deceptive purposes;

(b) Interfering with or disrupting the integrity, performance, or security of the Services;

(c) Attempting to gain unauthorized access to the Services, user accounts, or its related systems or networks;

(d) Engaging in any activity that could harm, disable, overburden, or impair the functionality of the Services or interfere with any other party's use of the Services;

(e) Using automated systems, bots, or scripts to access the Services without our express written permission;

(f) Uploading or transmitting viruses, malware, or any other malicious code that may damage or disrupt our Services;

(g) Violating any intellectual property rights, including copyrights, trademarks, or proprietary information belonging to Xfiat or third parties;

(h) Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity.

Violation of any of these prohibitions may result in immediate termination of your account and legal action where applicable.

4. Account Security

You are responsible for safeguarding your account credentials, including your password, PIN, and any two-factor authentication methods. Xfiat will never ask you for your password via email, phone, or any other communication channel.

If you suspect any unauthorized access to your account, you must notify us immediately. While we implement industry-standard security measures, you acknowledge that no system is completely secure, and you use the Services at your own risk.

5. Fees and Charges

Xfiat may charge fees for certain Services, including but not limited to transaction fees, conversion fees, and withdrawal fees. All applicable fees will be clearly displayed before you confirm any transaction.

We reserve the right to modify our fee structure at any time. Any changes to fees will be communicated to you in advance, and your continued use of the Services constitutes acceptance of the updated fees.

6. Service Availability

While we strive to provide uninterrupted access to our Services, we do not guarantee that the Services will be available at all times. The Services may be subject to maintenance, updates, or unforeseen technical issues.

Xfiat reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice. We shall not be liable for any loss or inconvenience resulting from service interruptions.

Legal Information

1. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in the jurisdiction applicable to your state or country of residence.

The arbitration shall be administered by a recognized arbitration association pursuant to its Comprehensive Arbitration Rules and Procedures. The decision of the arbitrator shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction.

Both parties agree to waive their right to a jury trial and to participate in class-action lawsuits. Any arbitration proceedings shall be conducted on an individual basis.

2. Limitation of Liability

To the maximum extent permitted by applicable law, neither Xfiat, its affiliates, directors, employees, suppliers, nor licensors shall be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.

In no event shall Xfiat's total liability to you for all damages, losses, or causes of action exceed the amount you have paid to Xfiat in the twelve (12) months preceding the claim.

You acknowledge that cryptocurrency transactions carry inherent risks, including price volatility, and you assume full responsibility for any financial losses incurred through the use of our Services.

3. Indemnification

You agree to indemnify, defend, and hold harmless Xfiat and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

4. Changes to Terms & Policy

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. It is your responsibility to review these Terms periodically for any updates.

We will notify you of significant changes via email or through an in-app notification. Your continued use of the Services following such notification constitutes your acceptance of the updated Terms.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your state or country of residence, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within your jurisdiction for the resolution of any disputes.

The invalid or unenforceable provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
